Who may avail of the Service:

Any Filipino Citizen having capacity to enter into contracts; Corporations, Partnerships, Associations of Cooperatives duly organized and existing under Philippine Laws authorized to engage in extracting sand and gravel and other quarry resources; Any person engaged in a business that requires requisition, use or application of sand, gravel and quarry resources

Requirement:

Industrial / Commercial Sand & Gravel, Quarry, Small-Scale Mining, Guano Commercial, Gemstone Gathering and  Pebble Picking

  • Mandatory
      1. Three (3) blue print copies and the original survey plan (B.L Form No. 1) of the area applied for duly sign and sealed by a license Geodetic Engineer, with the following documents attached:
          • Computations of Latitude and Longitude of corner “1” on separate sheet duly signed by Geodetic Engineer
          • Computation of conversation from Geographic to Grid & vice-versa for ref, monument & cor “1”
          • Professional Regulations Commission Card of Geodetic Engineer (front and back) and;
          • Photocopy of mines Geodetic Engineer Inc. Identification Card (front and back)
              • Note: The Geodetic Engineer shall be required to indicate the survey plan, the date of survey, his/her Professional License No., the duration of validity, including the Professional Tax Receipt (PTR) No., Lot No. and Owner(s) of Adjoining lots adjacent to the areas subject to application(s) and a CERTIFICATION to the effect that the applied area does not enroach on the private property(ies)
      2.  Notarized accomplished application form with 2×2 picture of the proponent
      3. Five (5) colored pictures of the applied area including all panoramic angles
      4. Endorsement through resolution from the Sangguiniang Barangay, stating among others, that the Barangay interposes no objection to the area of the subject of the application and that the proposed extraction will not adversely affect any proposal, on going, existing project of the barangay and signed by the majority of the control
      5. Excise Tax Clearance / Certificate of Registration from the Bureau of Internal Revenue
    • Additional Requirements
      1. Endorse from the Sangguniang Bayan / Panlungsod Concerned
      2. Area Clearance / Area Status from the MGB-R6 (for new applicants)
      3. Certifications of Posting of the endorsed Notice of Application from the Barangay, Municipality/City, PENRO and CENRO, PARO and MARO (for titled property stating that the area is not covered by CARP)
      4. Environmental Compliance Certificate (ECC) with site monitoring Report from EMB, DENR-R6
      5. Certificate of Environmental Management and Community Relations Record (CEMCRR) from MGB, DENR-R6
      6. Certificate from MGB-R6 as to compliance in the lodging of Rehabilitation Cash Fund (RCF) and Monitoring Trust Fund (MTF)
      7. Work Program (for Industrial SAG, Quarry and SSM; With format as provided by PEMO; signed by a licensed mining engineer)
      8. Mechanical processing equipment i.e. crusher of mechanized vibrating screen with specification, if applicable
      9. Proof of financial capability to undertake the project such as but not limited to BIR Income Tax Return, Bank Guarateed, Credit Lines and/or Certificate of Exemption from filing income tax
      10. Restoration / Rehabilitation Plan (with format as provided by PEMO)
      11. Surety Bond (P20,000.00/hectare) for operational damages
      12. Notarized Special Power of Attorney
    • Other Additional Requirements (where applicable)
      • If Corporation, Partnership, Association or Cooperatives
        1. Registered Articles of Corporation & By-Laws
        2. Certificate of registration of corporation/partnership/association/cooperative
        3. Notarized Secretary’s Certificate or Board Resolution assigning an authorized representative of liaison officer
      • If Private Land
        1. Certificate photocopy of Transfer of Certificate of Title of Original Certificate of Title
        2. Notarized affidavit of lot Owner’s Consent
        3. Certification from MARO and PARO, stating among others that the applied area is not covered by CARP or any DAR Program
      • If Public Land
        1. Certification as to status of land from CENRO concerned
  • Government Gratuitous Permit
      1. Notarized accomplished application form with 2×2 picture of the proponent
      2. Letter request from the proponent
      3. Resolution from the concerned barangay stating that said Barangay interposes no objection to proposed project
      4. Survey plan of the target area duly signed by Licensed Geodetic Engineer
      5. ECC of Certificate of Non-Coverage of ECC from DENR
      6. Work program indicating the time frame of extraction, volume needed, where materials are supplied
      7. Statement that there is no fund allocation for the cost of required materials and that the project is conducted by administration
      8. Payment of requirement fees as stipulated in this ordinance
  • Private Gratuitous Permit & Gratuitous Guano Permit
      1. Notarized accomplished application form with 2×2 picture of the proponenet
      2. Resolution from the concerned barangay stating that said Barangay interposes no objection to proposed project
      3. Brief project description and Work program
      4. Proof of ownership (Certificate True Copy of Title)
      5. Sketch plan (Engineers signature not required) and Pictures of the area
      6. Field inspection and favorable endorsement of PEMO
      7. ECC of Certificate of Non-Coverage of ECC from DENR
  • Exclusive Sand & Gravel
      1. Notarized accomplished application form with 2×2 picture of the proponent
      2. Resolution from the concerned barangay stating that said Barangay interposes no objection to proposed project
      3. Brief project description and Work program
      4. Sketch plan (Engineers signature not required) and Picture of the area
      5. Field inspection and favorable endorsement of PEMO
      6. Letter-request from the proponent
  • Special Permit
    • To dispose stockpiled materials previously covered by a permit
      1. Notarized accomplished application form with 2×2 picture of the proponent
      2. Resolution from the concerned barangay attesting the stockpiled materials extraction
      3. Notarized Ending Inventory
      4. Letter-request to the Provincial Governor
      5. Payment of fees as stipulated in the Provincial Tax Ordinance
    • Other Special Permits
      1. Notarized accomplished form with 2×2 picture of the proponent
      2. Sketch plan (Engineers signature not required) and Pictures of the area
      3. Work program stating the volume needed, where materials are supplied and time-frame of the project
      4. Certificate of no budget allocation, if project is to be undertaken by the administration
      5. Payment of fees as stipulated in the Provincial Tax Ordinance
  • Ore Transport Permit and Mineral Ore Export Permit
      1. Duly accomplished application form with 2×2 picture of the proponent
      2. Submission of contract between the shipper/permit holder and the owner of the conveyance, if necessary
      3. Ore Transport Permit with the corresponding volume of tonnage duly issued by the Provincial Treasurer of Negros Occidental
      4. Number of conveyances to be used and its carrying capacity
